Terms of Service

Operator. Kovmere is a service of Content Commerce Labs LLC, doing business as Kovmere (the "Company," "we," or "us"). You can reach us through Contact us, by replying to any receipt, order, or report email you have received from us, or by mail at Content Commerce Labs LLC, 100 North Howard Street STE R, Spokane, WA 99201, US.

Agreeing to these terms. You agree to these terms when you click a button that says you agree to them, when you buy a paid product, or when you start a reading after being shown a clear link to this page — whichever happens first. If you are acting for a company or other organization, you are confirming you have authority to bind it to these terms.

Business use. The service is offered for business and professional use. By buying or using it, you are confirming you are doing so for your business or profession, not for personal, family, or household purposes.

What the service does. The service samples answers from third-party AI search engines (currently the OpenAI, Perplexity, Gemini and Claude search APIs, and Google AI Overviews, read through DataForSEO, a search-data provider) for a set of buyer questions about your category, and reports what those samples contained. It also fetches your pages as those engines' crawlers and as a browser, and reports what came back. Samples are of the engines' APIs, not their consumer apps, and results vary by time and by engine. The API measurements we use carry no memory, location or personalisation, but the engines' own apps can vary by region and personalisation. We do not promise, guarantee or predict rankings, mentions, citations or any business outcome.

Delivery guarantee. Your card is charged at checkout. If the initial measurement still cannot complete after one automatic re-run, the payment is refunded automatically. We do not guarantee rankings, citations, traffic or revenue. A run that ends incomplete — an engine did not answer, fewer answers came back than the run promised, or the question set is shorter than the plan includes — is flagged as incomplete on your report and in the email that delivers it. Requests that failed are retried once automatically during the measurement. A report is released only when at least 4 of the 5 engines are measured and at least 80% of the expected buyer-question answers are validly judged; a report below that is not published. An engine still missing from a released report can be re-run free from the report page (a weekly pulse is not re-run; the next pulse asks every engine again). A missing answer is never counted as a zero. Beyond the automatic refund of an initial measurement that cannot complete (for an initial Pro or Agency Portfolio purchase, together with cancellation of the subscription), we do not issue refunds against that flag. Google AI Overviews may not surface for some or all sampled questions. When no overview appears, we report that state and exclude it from visibility rates; it does not trigger a rerun or refund. Nothing in this paragraph promises a ranking, a mention, a citation, traffic or revenue.

Paid products and recurring charges. Check costs $19 as a single charge: it does not renew, there is no subscription to cancel, and it may be bought again at any time. Pro costs $49 each month and Agency Portfolio costs $129 each month including 3 active client websites, with each additional active client website $39 per month. The total shown at checkout is the amount charged. Completing checkout on a monthly product authorizes that monthly charge until cancellation; completing checkout on Check authorizes one charge and no other. You may cancel through the customer-bound billing link in every receipt or in your account, without a phone call. Cancellation takes effect at period end: paid delivery and access continue through that date, and there is no later charge. If a Check, or the first reading of a new Pro or Agency Portfolio plan, cannot be measured, the payment is refunded automatically (see Delivery guarantee); otherwise no refunds are offered or provided. This does not limit a right that applicable law makes mandatory.

Generated material. Page updates, profile copy, cited-page records and technical files are produced by AI models from the public pages of your own website and the measurements from your own reading; every fact about you in them comes from your own website, and there is no form to fill in. They are supplied as proposals in a pending state, not published for you, and not a guarantee of citations. We never publish anything on your site, your profiles or anyone else's, and connecting a CMS does not change that — a CMS button creates an unpublished draft in your own system and nothing more. AI-generated material can be inaccurate, incomplete, outdated, or similar to material produced for someone else, and we do not represent that it is factually correct, legally compliant, original, or free of third-party rights. You are responsible for independently reviewing, fact-checking, editing and approving everything before you publish or send it, and for the accuracy and legality of anything you choose to use. Nothing we produce, and nothing on this site, is legal, tax, or financial advice — get your own before relying on it for a business or compliance decision.

Your content. You confirm that you are entitled to submit the website, the brand, the competitor names and the facts you provide, that any figures or comparative claims you enter are ones you can substantiate, and that you will not ask the service to produce material you know to be false. You grant us a limited, non-exclusive license to use what you submit only to run your reading, generate the materials you paid for, and operate and improve the service as described in the privacy policy. Do not submit confidential, regulated, or highly sensitive information — this service is not built to hold it.

Viewing is by link; changes need a login. Report and share URLs are unguessable but unauthenticated; anyone holding one can view it. Changing a report, opening your account and opening an Agency workspace need a login with that account's email address and password, and a workspace opens only for its owner and the team members the owner added. Keep report links as you would keep any private document. We are not liable for what follows from a link you chose to share, though this does not excuse us from our own security failures.

Email. Service email tied to a reading, order or alert you started is part of the service and is not optional while you use it. Promotional follow-up email about upgrading is sent only if you tick the box offering it; every message carries an unsubscribe link, and unsubscribing stops those without affecting service email.

Your data. Privacy, retention and the self-serve deletion route are set out in the privacy policy.

Acceptable use. No measuring at scale of sites you have no legitimate interest in, no reselling of a report you did not buy, no attempts to bypass rate limits, spend caps or payment, no use of the fix generator to produce material you know to be false.

Third-party costs and changes. Engines, models and APIs change, throttle or disappear. An API that cannot show which pages its answers came from is marked “not measured,” and no rate is printed for it. Checkout is refused when no required engine can run; an initial payment whose measurement still cannot complete after one automatic re-run is refunded automatically. Later work we still owe you is re-run without an additional fee. If that work cannot run before a renewal, we pause that renewal’s charge or refund it until the work can run.

Suspension and termination. We may suspend or end access for fraud, abuse, non-payment, or a violation of the Acceptable Use section above, with notice where practical. Ending access does not reverse charges for completed paid periods and does not limit rights that applicable law makes mandatory.

Liability. The service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. To the extent permitted by law: we are not liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, or data, arising from your use of the service; and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in this section limits liability that cannot be limited by law.

Governing law. These terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules, and any dispute not resolved informally may be brought in the state or federal courts located in Washington. If you are located somewhere that gives you mandatory consumer protections regardless of this clause, those protections still apply.

Severability and entire agreement. If any part of these terms is unenforceable, the rest stays in effect. These terms, together with the privacy policy and the cancellation policy, are the entire agreement between you and the Company about the service.

Legacy appendix — retired products and optional features

These clauses apply only to workspaces created under the original Agency plan, retired in September 2026 and not the same product as Agency Portfolio, that still hold an API key; and to the optional CMS draft-push feature where it is switched on. No product sold today, Agency Portfolio included, includes them.

API and webhooks. No product we sell today includes a JSON API or webhook delivery, and none is promised with any of them. Workspaces created under that original, retired Agency plan may ask us for their workspace key and use the JSON API with it as a bearer token, subject to the published rate limit. You are responsible for every call made with your key and for keeping it secret; tell us at once if it leaks and we will reissue it. Webhook delivery is best-effort — one attempt, plus a single retry 30 seconds later for a timeout or a 5xx response, never for a 4xx and never more than once, no signature — and is not a guaranteed delivery channel; poll the API if you need reliability.

CMS connections. If you connect a CMS you warrant that you are authorised to do so. Use a separate, revocable, least-privilege credential where your CMS supports one, rather than a master password or a key with more access than the drafting feature needs; you are responsible for revoking it if it is ever exposed. Credentials are stored against that single reading, used only to create drafts you explicitly click, and removed when you disconnect or delete your data. The Company is not responsible for changes made in your CMS after a draft lands there.
