Terms of Service

Operator. Kovmere is a service of Content Commerce Labs LLC, doing business as Kovmere (the "Company," "we," or "us"). You can reach us through /contact, by replying to any receipt, order, or report email you have received from us, or by mail at Content Commerce Labs LLC, 100 North Howard Street STE R, Spokane, WA 99201, US.

Agreeing to these terms. You agree to these terms when you click a button that says you agree to them, when you buy a paid product, or when you start a scan after being shown a clear link to this page — whichever happens first. If you are acting for a company or other organization, you are confirming you have authority to bind it to these terms.

Business use. The service is offered for business and professional use. By buying or using it, you are confirming you are doing so for your business or profession, not for personal, family, or household purposes.

What the service does. The service samples answers from third-party AI search engines (currently the OpenAI and Perplexity APIs) for a set of buyer questions about your category, and reports what those samples contained. It also fetches your pages as those engines' crawlers and as a browser, and reports what came back. Samples are of the engines' APIs, not their consumer apps, and results vary by time, region and personalisation. We do not promise, guarantee or predict rankings, mentions, citations or any business outcome.

Paid products and recurring charges. One-time purchases deliver the scan and materials described on the pricing page for the tier you bought, plus any tax we are required to collect. Announced credits — the Check's $29 against a Fix Pack, the Fix Pack's $99 against a first subscription payment — are applied at checkout as a discount; they reduce a future price and are never redeemable for cash. Subscriptions renew automatically at the price and interval shown at checkout, plus applicable tax, until cancelled — completing checkout for a subscription is your authorization for that recurring charge. You may cancel online through the billing-management link supplied after purchase; if that link does not work, contact us through /contact or by replying to your receipt, and we will process the cancellation without requiring a phone call or another purchase. Cancelling stops future renewals only — access, and any re-test it includes, continues to the end of the period you already paid for.

Generated material. Drafts, profile copy, correction emails and technical edits are produced by an AI model from the facts you enter and the measurements from your own scan. They are supplied as proposals in a pending state, not published for you, and not a guarantee of citations. We never publish anything on your site, your profiles or anyone else's, and connecting a CMS does not change that — a CMS button creates an unpublished draft in your own system and nothing more. AI-generated material can be inaccurate, incomplete, outdated, or similar to material produced for someone else, and we do not represent that it is factually correct, legally compliant, original, or free of third-party rights. You are responsible for independently reviewing, fact-checking, editing and approving everything before you publish or send it, and for the accuracy and legality of anything you choose to use. Nothing we produce, and nothing on this site, is legal, tax, or financial advice — get your own before relying on it for a business or compliance decision.

Your content. You confirm that you are entitled to submit the website, the brand, the competitor names and the facts you provide, that any figures or comparative claims you enter are ones you can substantiate, and that you will not ask the service to produce material you know to be false. You grant us a limited, non-exclusive license to use what you submit only to run your scan, generate the materials you paid for, and operate and improve the service as described in the privacy policy. Do not submit confidential, regulated, or highly sensitive information — this service is not built to hold it.

Access is by link. Report, fix-pack, share and workspace URLs are unguessable but unauthenticated; anyone holding one can view it, and an Agency workspace URL contains the owner key. Keep them as you would keep a password. We are not liable for what follows from a link you chose to share, though this does not excuse us from our own security failures.

API and webhooks. Agency workspaces may use the JSON API with the workspace owner key as a bearer token, subject to the published rate limit. You are responsible for every call made with your key and for keeping it secret; tell us at once if it leaks and we will reissue it. Webhook delivery is best-effort — one attempt, plus a single retry 30 seconds later for a timeout or a 5xx response, never for a 4xx and never more than once, no signature — and is not a guaranteed delivery channel; poll the API if you need reliability.

CMS connections. If you connect a CMS you warrant that you are authorised to do so. Use a separate, revocable, least-privilege credential where your CMS supports one, rather than a master password or a key with more access than the drafting feature needs; you are responsible for revoking it if it is ever exposed. Credentials are stored against that single scan, used only to create drafts you explicitly click, and removed when you disconnect or delete your data. The Company is not responsible for changes made in your CMS after a draft lands there.

Email. Service email tied to a scan, order, alert or re-test you started is part of the service and is not optional while you use it. Promotional follow-up email about upgrading is sent only if you tick the box offering it; every message carries an unsubscribe link, and unsubscribing stops those without affecting service email.

Your data. Privacy, retention and the self-serve deletion route are set out in the privacy policy.

Acceptable use. No scanning at scale of sites you have no legitimate interest in, no reselling of free scans, no attempts to bypass rate limits, spend caps or payment, no use of the fix-pack generator to produce material you know to be false.

Third-party costs and changes. Engines, models and APIs change, throttle or disappear, sometimes without notice. We may substitute an equivalent engine or change models; such a substitution is not a breach. If a tier you paid for names a specific engine and that engine is unavailable for your scan, the refund policy — not this clause — decides what you are owed, and the report says on its face what ran.

Suspension and termination. We may suspend or end access for fraud, abuse, non-payment, or a violation of the Acceptable Use section above, with notice where practical. Ending access does not entitle you to a refund beyond what the refund policy already provides, and does not excuse charges already incurred.

Liability. The service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. To the extent permitted by law: we are not liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, or data, arising from your use of the service; and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in this section limits liability that cannot be limited by law.

Governing law. These terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules, and any dispute not resolved informally may be brought in the state or federal courts located in Washington. If you are located somewhere that gives you mandatory consumer protections regardless of this clause, those protections still apply.

Severability and entire agreement. If any part of these terms is unenforceable, the rest stays in effect. These terms, together with the privacy policy and the refund policy, are the entire agreement between you and the Company about the service.
